Protection of property and contractual freedom in Roman law and as part of the Legacy of Roman law

A kutatási téma leírása:

The concept of property and its protection and contractual freedom as developed by the ancient Roman jurists form fundamental pillars of the modern rule of law.
These two central legal institutions were transferred to modern private law regulatory systems with almost unchanged content.
During the more than two-thousand-year-long evolution of Roman private law several versions of the interpretation of these legal institutions became known, although their scientific research can be regarded as relatively young, since the trends and schools which distinguish between the ancient private law and the results of the medieval and modern development of law were formed from the 19th century onwards.
Thus, the doctoral subprogram focuses on research activities based on the interpretation of primary sources, the use of the secondary literature of modern Romanic states, and the adaptation of the results of other areas of science which qualify as auxiliary sciences of Roman law (epigraphy, papyrology, comparative legal history, ancient social and economic history, ancient cultural history, etc.).
The dogmatical program, which focuses on the institutions of law, also aims to introduce the development of the history of the given regulation: the historical and comparative legal methods thus serve as important elements of the program.
Chronologically the subprogram covers primarily the private law of Ancient Rome, but in a wider sense all areas of Romans’ legal life.
It is important to notice that the school’s training and research field encompasses not only the institutions of the Roman law on property and obligations, but the institutions of the law of succession, marital property law and Roman procedural law as well.
Beyond that the three-year program also concerns the protection of property and the fields of criminal and public law.
The legacy of Roman law aims to examine primarilythe medieval and modern development of law until the appearance of the modern codes of private law.
Property and contractual freedom are also central issues of the drafting of national and European civil law codes nowadays.
The purpose of the educational program is to acquaint PhD students with the fundamentalsources of Roman law, the Roman instruments of interpreting the sources and those scientific research methods of the Roman jurists and basic literature which form the basis of modern scientific works.
