A kutatási téma leírása:

The sui generis legal order of the European Union has entered a new era with the Lisbon Treaty, yet the reformed Union still faces numerous legal (and other) challenges. Intensive EU law-making, the coexistence of supranational and intergovernmental elements, the dynamic interpretation of law by the Court of Justice of the European Union (especially in connection with the protection of the rights of individuals) will present challenges for legislators and those who apply the law at national and supranational level as well. The correlation and interaction of international law, EU law and national law is also of special interest in this regard, including but not limited to the question of applicability of international law within the legal order of the Union.
The fact that numerous facets of member state sovereignty are exercised commonly within the EU framework has an ever increasing effect on the sensitive area of justice and home affairs cooperation as well. The establishment of an area truly based on freedom, security and justice entails a lengthy and complex regulatory process, where the concept of mutual trust (a concept difficult to grasp from a purely legal point of view) also plays an important role. The entry into force of the Lisbon Treaty, the endowment of the Charter of Fundamental Rights with binding force, and the planned accession of the EU to the European Convention on Human Rights brings up new perspectives and possibilities for many different actors, including individuals. The status of EU citizenship also more and more often raises questions of law in the jurisprudence of the Court of Justice which cut to the core of EU law.
The correlation between the various institutions is also not of a static nature (indicated inter alia by inter-institutional legal basis disputes), and due to the EU’s accession to the ECHR, EU legislation and law will be subject to a truly external human rights standard for the first time. The democratic legitimacy of Union institutions also deserves further research, mostly regarding the regulatory framework defining the role of parliamentary institutions in the Union and its possible ongoing reform.
The doctoral research topic aims to find answers regarding the abovementioned dilemmas of EU public law.
